If you are getting a divorce in California, there are many things you will want to think about. There are five main aspects that you should keep in mind throughout the process.
1. Patience
Nothing happens overnight and divorce is no different. The State of California requires at least a six month cooling off period before a divorce can be granted.
2. Alimony
Alimony (spousal support) is not just for the wife in California. If you make more than your spouse, then you may be required to pay alimony to them. With this, the courts will look at the actual income as well as the income potential to determine which spouse (if any) must pay alimony).
3. Community Property
This is the term for all property that was attained during the marriage, even if it was only in one spouse's name. The property is set to be divided equally between the couple. Even debts that were gained during the marriage will be split equally.
4. Children
California prefers that the parents work out the custody arrangement. If this cannot be done, then there are custody hearings, though this can get expensive.
5. Be Sure You Want the Divorce
When you figure in the time that you will put into this as well as the costs, including a divorce attorney, splitting up property and more, it can be costly. This is why you want to make sure it it something you want to do.
